3. Services Description
3.1 IV Hydration Therapy
DripRN offers IV hydration therapy, including IV fluid hydration with vitamin and mineral options, as prescribed by our licensed medical professionals. The Services are provided through a mobile clinic, allowing Clients to receive treatment at their home, business, hotel, or other designated locations.
3.2 Consultation and Treatment Procedures
The Services include an initial consultation with a licensed physician (e.g., Dr. M Ikeda) via teleconference, assessment by a nurse, and the administration of IV therapy as prescribed. The Services are provided in accordance with applicable medical standards, regulations, and best practices in the State of Texas.
Teleconference consultations, including initial consultations with a doctor, may include any of
the following: video, audio, electronic message. These methods are utilized to ensure effective communication and care tailored to the client's needs.
4. Client Onboarding Process
4.1 Consent Forms
All new Clients are required to sign consent to treatment and HIPAA forms. These forms must be completed using the CleverWaiver app/software, and Clients are offered an email copy upon request.
We may utilize third-party software, such as CleverWaiver or other third-party software, for obtaining consents for treatment. This includes the use of electronic signatures and digital forms. We reserve the right to change or add other software as needed, in compliance with applicable laws and regulations.
4.2 Assessments and Consultations
The onboarding process includes an assessment by a nurse, including medical history and vital signs, and an initial consultation with a licensed physician via teleconference. After the Client verbally agrees and all consents are signed, the nurse will start the IV to begin therapy.
Our telecommunication methods for treatment and consultation may include any of the following: video, audio, electronic message. These methods enable us to provide personalized care and maintain open communication with clients, regardless of location.
These changes specify the modes of telecommunication that may be used in the provision of services, offering clarity and transparency to clients.
5. Consent Procedures
5.1 Consent for Treatment
Clients must read and sign consents for treatment and HIPAA on a data communications device using the CleverWaiver app/software. The consent forms outline the treatment procedures, associated risks, and the Client's rights.
We may employ third-party software, such as CleverWaiver or other third-party software, for collecting personal and health information. This enables us to gather necessary details for treatment planning, billing, and other specific reasons related to the services we offer.
5.2 Use of CleverWaiver App/Software
The CleverWaiver app/software is used to obtain and document Clients' agreement to receive treatment. It includes verbal or written consent and outlines the treatment, any associated risks, and the Client's rights.
Our client onboarding process, consent procedures, and other client interactions may be facilitated through third-party software, such as CleverWaiver or other third-party software. This includes scheduling appointments, signing consent forms, and other procedures essential to our services.
6. Payment Terms
6.1 Pricing Structure
The pricing structure for the Services is determined by DripRN and is available upon request or as detailed on our website. Prices may vary based on the specific treatment, location, and
other factors. All prices are in USD.
6.2 Payment Methods
Payment for the Services must be made using acceptable methods, including credit card, debit card, or other payment platforms as specified by DripRN. Payment must be made in full prior to the provision of Services unless otherwise agreed in writing.
7. Cancellation and Refund Policy
7.1 Cancellation Fees
● Cancellations made 4-6 hours before the scheduled appointment will incur a $50 cancellation fee.
● Cancellations made 3-1 hours before the appointment will incur a $75 fee. All cancellation fees are non-refundable.
7.2 Refund Procedures
Refunds for Services not rendered will be processed in accordance with applicable laws in the State of Texas. Refund requests must be made in writing and submitted within a specified timeframe as determined by DripRN.
8. Warranties and Guarantees
8.1 Loyalty Membership Program
Clients may participate in the Loyalty Membership program, agreeing to a consecutive 3 months of IV hydration use once a month. Specific terms, including charges for months missed, will apply as detailed in the program's agreement.
8.2 Disclaimers
DripRN does not guarantee any cures or treatments for ailments or diseases. IV therapy does not replace emergency medical care. Clients must consult their physician or go to the nearest emergency room if needed. Age restrictions and other limitations may apply.
9. Liability Limitations
9.1 Limitations of Liability
To the fullest extent permitted by law, DripRN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from the use or inability to use the Services.
9.2 Indemnification
You agree to defend, indemnify, and hold harmless DripRN, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

11. Intellectual Property Rights

All intellectual property rights, including but not limited to trademarks, copyrights, logos, and content related to the Services, are owned by DripRN Mobile IV LLC or its licensors. Unauthorized use, reproduction, or distribution of these intellectual property rights is strictly prohibited.
11.2 Copyrights and Trademarks
The DripRN name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DripRN or its affiliates. You must not use such marks without the prior written permission of DripRN.
12. User Conduct and Responsibilities
12.1 Client Responsibilities
Clients are responsible for providing accurate and complete information during the onboarding process, complying with all applicable laws, and adhering to the guidelines and procedures outlined by DripRN.
12.2 Prohibited Activities
Clients are prohibited from engaging in any unlawful activities, including but not limited to fraud, misrepresentation, or any conduct that would violate the rights of DripRN or others, or give rise to civil or criminal liability.
13. Telemedicine Practices
13.1 Telecommunication Procedures
DripRN provides telemedicine services, including interactive audio, video, and/or data communications. Clients must have access to the necessary technology and agree to the use of telecommunication for consultations, assessments, and treatment planning.
13.2 Technology Requirements
Clients are responsible for ensuring that they have the necessary technology, including internet access, to engage in telemedicine services. DripRN is not responsible for any technical issues on the Client's end that may hinder the provision of Services.
14. Complaints and Grievances
14.1 Complaint Procedures
Clients may file a complaint with DripRN regarding any aspect of the Services. All complaints must be submitted in writing to the designated contact provided by DripRN. Complaints will be addressed in accordance with applicable laws and regulations in the State of Texas.
14.2 Resolution
DripRN will make reasonable efforts to investigate and resolve complaints in a timely and fair manner. Clients will be informed of the outcome of their complaint and any actions taken by DripRN.
15. Amendments and Modifications
15.1 Changes to Terms
DripRN reserves the right to amend or modify these Terms at any time, in its sole discretion. Any changes will be effective immediately upon posting on the website or other notification methods.
15.2 Notification
Clients are responsible for regularly reviewing these Terms to stay informed of any changes. Continued use of the Services after any changes to the Terms constitutes acceptance of those changes.
16. Termination Rights

Clients may terminate their engagement with DripRN by providing written notice in accordance with the cancellation policy outlined in Section 7.

DripRN reserves the right to terminate the provision of Services to any Client for reasons including but not limited to non-compliance with these Terms, non-payment, or any unlawful activities.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
17.2 Jurisdiction
Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the federal or state courts located in Texas, and you hereby consent to the jurisdiction and venue of such courts.
18. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be resolved through binding arbitration in Texas, in accordance with the rules of the American Arbitration Association.
